Terms governing use of the Ativo Home Care website and your relationship with our private-pay in-home care services. Effective 2026.

Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of the Ativo Home Care website at ativohomecare.com and any related online tools operated by Ativo Home Care ("Ativo," "we," "us," or "our").

By accessing or using this website, you agree to these Terms. If you do not agree, do not use the site. Separate written agreements, care plans, or service authorizations may apply when you become a paying client; those documents control your care relationship where they conflict with these Terms.

Effective date: January 1, 2026.

Service Description

Ativo Home Care provides premium, private-pay, non-medical in-home senior care in Arizona and New Mexico, including markets such as Buckeye, Prescott Valley, Yuma, Lake Havasu City, and Albuquerque and surrounding communities. Services may include companion care, personal care, memory care support, respite care, and transition care, as described on this website and in your individualized care plan.

We do not bill Medicare, Medicaid, or private health insurance directly for standard home care services. Care availability, pricing, and scope are subject to assessment, geographic service area, and staffing. Information on this website is for general purposes and does not create a care relationship until we accept you as a client in writing or through our onboarding process.

Website Use and User Responsibilities

You agree to use this website only for lawful purposes and in a manner that does not infringe the rights of others or interfere with the operation of the site.

  • Provide accurate information when submitting forms or contacting us.
  • Do not attempt to gain unauthorized access to our systems, data, or accounts.
  • Do not upload malware, scrape the site in violation of our robots rules, or use automated means to harvest content without permission.
  • Do not use the site to transmit unlawful, harassing, or misleading content.

This website and its content are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not warrant that the site will be uninterrupted, error-free, or free of harmful components. Care outcomes depend on many factors outside our control. Nothing on this site guarantees a particular result from home care services.

Limitation of Liability

To the fullest extent permitted by Arizona law, Ativo Home Care and its officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of this website or reliance on its content, even if we have been advised of the possibility of such damages.

Our total liability for claims arising solely from your use of this website (and not from a separate care services agreement) is limited to the greater of one hundred U.S. dollars ($100) or the amount you paid to us for website-related services in the twelve months before the claim, if any.

Some jurisdictions do not allow certain limitations. In those cases, our liability is limited to the maximum extent permitted by law. Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for gross negligence or intentional misconduct where prohibited.

Indemnification

You agree to defend, indemnify, and hold harmless Ativo and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your misuse of the website, violation of these Terms, or violation of any third-party rights.

Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict-of-law principles. Subject to the dispute resolution section below, exclusive venue for disputes relating to these Terms and this website lies in the state or federal courts located in Maricopa County, Arizona, and you consent to personal jurisdiction in those courts.

Dispute Resolution

Before filing a formal claim, you agree to contact us and attempt in good faith to resolve the dispute informally within thirty (30) days.

If informal resolution fails, any dispute arising out of or relating to these Terms or this website (other than claims for injunctive relief) may, at either party's election, be resolved through binding arbitration administered under the rules of the American Arbitration Association, with the arbitration held in Maricopa County, Arizona, unless the parties agree otherwise in writing.

You may opt out of the arbitration agreement within thirty (30) days of first accepting these Terms by sending written notice to the contact email below with your name, address, and a clear statement that you decline arbitration. If you opt out, disputes will be resolved in court as described in the Governing Law section.

Class action and representative proceedings are waived to the extent permitted by law. If a court finds any portion of this section unenforceable, the remainder still applies to the fullest extent allowed.

Modifications to Terms

We may update these Terms at any time by posting a revised version on this page with an updated effective date. Your continued use of the website after changes become effective constitutes acceptance of the revised Terms. For material changes, we may provide additional notice where appropriate.

General Provisions

If any provision of these Terms is held invalid, the remaining provisions remain in full force. Our failure to enforce a provision is not a waiver of our right to do so later. You may not assign your rights under these Terms without our consent. We may assign our rights in connection with a merger, acquisition, or sale of assets.

These Terms, together with our Privacy Policy and any applicable client service agreement, constitute the entire agreement regarding use of this website.
